Man in wheelchair injured on disable ramp sidewalk, sues Houston and Mayor Turner for $1M plus

Man claims the ramp sidewalk was “in an unsafe condition” and raised and cracked which caused him to fall and suffer multiple “severe, incapacitating and life-threatening” injuries.

HOUSTON — A man who was injured on a raised and cracked disable ramp sidewalk in Houston is claiming the city’s negligence.

Javier Vargas Dominguez filed a complaint July 23 in Harris County District Court against City of Houston, Silvester Turner, Ronald C. Lewis and Mary L. Sharp alleging negligence.

Dominguez alleges in his complaint that he was commuting on his wheelchair on a city of Houston disable ramp sidewalk in front of a building on High Star Drive. He claims the ramp sidewalk was “in an unsafe condition” and raised and cracked which caused him to fall and suffer multiple “severe, incapacitating and life-threatening” injuries.

Specifically, Dominguez alleges he suffered a broken leg, a prosthetic femur fracture, a staph infection, tachycardia and required four surgeries due to his injuries. He claims the city of Houston was negligent for not having a level sidewalk that is free from hazards and failed to maintain the sidewalk in a safe condition.

Domiguez further claims the city of Houston failed to properly inspect the disable ramp and comply with state and federal laws and regulations.

Dominguez seeks monetary relief of more than $1 million, trial by jury, interest and all other just relief. He is represented by Attorney William Jones, Jr., in Houston.
